01Scope and contract documents
These terms cover VISION TOTALE services for businesses, associations, public bodies and individuals. They supplement the quotation, approved brief and any special terms supplied to the client. The contract identifies the version applicable when made; a website update does not retrospectively change an accepted order.
Agreed special terms take priority over compatible general provisions. No clause overrides mandatory consumer protections. The English translation assists understanding and does not deprive a client of information they are entitled to receive.
02Quotation, booking and scope
The quotation specifies services, locations, dates or deadlines, attendance time, deliverables, formats, included revision rounds, price, expenses, payment schedule and usage rights. An enquiry or preliminary discussion alone does not reserve a date. Booking follows the acceptance and payment arrangements supplied to the client.
The final price distinguishes amounts before and including tax, applicable VAT and additional expenses. Consumers receive the total including tax before committing. The quotation states its validity period. Any scope extension requires written agreement on cost and timing.
03Payment and invoicing
Advance amounts, their legal nature, instalments and balance are specified in the contract documents. This page imposes no universal advance percentage. Payment methods are those offered for the order.
Business invoices specify applicable late-payment interest and the statutory €40 recovery fee. That business recovery fee does not apply to consumers. Any suspension for non-payment must comply with the contract, proportionality and applicable formalities.
04Preparation and client responsibilities
The client supplies a reliable brief, an authorised approver, location and access details, required materials and publication constraints. Together with Vision Totale, the client arranges location, filming and image permissions within their responsibility.
Premises, products and properties must be accessible and prepared as agreed. Delayed access, missing information or schedule changes may require an adjustment, which is explained and agreed. The client’s mandatory rights remain applicable.
05Photography, films, weddings and events
The brief defines style, priority moments and coverage arrangements. For weddings and events, capture depends on the actual programme, access, light, venue rules and participant cooperation. No implicit promise is made to capture every guest, gesture or instant.
Attendance, travel, possible extra hours, sound recording and deliverables are specified in the quotation. Creative and editing choices follow the approved scope; a new preference after production may be an additional request.
06Drone work and safety
Aerial capture depends on legal and operational feasibility: area, permissions, weather, third parties, obstacles and local restrictions. The remote pilot retains the safety decision. A client cannot require a prohibited or unsafe flight.
Where flying is not feasible, we assess postponement or an alternative. A location or date in a brief is not flight authorisation. Effects on scope and price are handled under the quotation and law.
07Property, plans and digital creation
Virtual staging, retouching, 3D plans and tours made from supplied files follow the agreed scope and the quality of the source material. A furnishing visual may depict a proposal; it must not be presented as an unaltered photograph of the property.
Unless an expressly agreed survey is included, plans and representations are not statutory measurements, surveys or construction documents. The client checks factual listing information and clearly identifies relevant alterations.
08Social content and assisted tools
Formats, versions and subtitles are set in the quotation. Publishing, moderation, community management, media buying and advertising spend are included only where expressly agreed. We do not guarantee view counts, sales or follower growth.
AI, generation and retouching tools must respect authorised source material, depicted people and the brief. Limitations of generated content and third-party licences are identified where they affect the intended use.
09Approval, feedback and changes
The quotation or schedule specifies approval stages, included revision rounds and contacts. The client consolidates feedback clearly. A changed brief, extra version or rework after approval may require an additional quotation.
Silence does not automatically accept an extra charge or waive a remedy. Delayed approval can move the schedule; the revised timing is communicated. Corrections of a defect in the service are distinguished from new requests.
10Delivery, source files and backups
Delivery uses the agreed formats, resolutions and channels. Raw footage, RAW photographs, editing projects, models and working files are included only if the quotation says so. Samples and previews are not necessarily final files.
Link, gallery and archive availability is specified in the delivery information or quotation. The client downloads and backs up deliverables within that period. Permanent archiving or restoration is not assumed to be included. This does not remove remedies for a delivery defect.
11Copyright, licences and image rights
Contract documents define licensed or assigned rights: permitted uses, media, territory, duration, possible exclusivity and payment conditions. Purchasing a service does not automatically transfer unlimited rights or source files. Moral rights remain protected.
The client must hold the necessary rights to supplied brands, music, text, images and files. Third-party music, fonts and assets retain their own licence restrictions.
Permission to use imagery in Vision Totale’s marketing is separate from placing an order, particularly for weddings, portraits and children. A blanket promotional release is not inferred from the contract.
12Confidentiality and client workspace
Each party protects non-public information received for the assignment. Authorised recipients, sharing links and providers are limited to project needs. Access credentials are personal; promptly report loss or suspicious use.
Workspace messages and approvals support project coordination. They do not replace specific permissions or a contract amendment where one is required. Data processing is described in the privacy policy.
13Withdrawal, cancellation and recurring services
The Refund policy explains withdrawal, postponement and complaints. Any specific cancellation terms must be supplied and accepted before the order.
A recurring-service contract specifies duration, frequency, any renewal, notice and cancellation methods. Statutory information duties and, where applicable, online termination requirements remain mandatory. This page creates no automatic renewal.
14Liability, complaints and applicable law
Duties and liability are assessed under the assignment, contract and law. No general exclusion covers liability that cannot be excluded, personal injury or mandatory consumer rights. Non-performance is addressed through applicable remedies, without an automatic liability cap introduced by this page.
French law applies, subject to a consumer’s mandatory protections. Complaints may be emailed to contact@visiontotale.fr. Consumer mediation, where applicable, is free for the consumer; appointed-mediator details await confirmation and must be supplied before a consumer order. Court jurisdiction follows the applicable rules, without an exclusive venue imposed here on a consumer.
